Petalas Smart System Terms of Service

Welcome to the Petalas Smart Litter System and related services ("Product"). These Terms of Service ("Terms") constitute a binding legal agreement between you and Petalas ("we", "us", "the Company") concerning your use of the Product and Services.

1. Acceptance of Terms

By accessing or using the Petalas website, purchasing, or using the Petalas Smart Litter System, its accompanying application, and firmware, you agree to be bound by and accept all provisions of these Terms. If you do not agree to these Terms, please do not purchase or use the Product.

2. Product Purchase and Use

2.1 Product Limitations and Compatibility

• Designated Washable Litter Requirement: To ensure system functionality and longevity, the Petalas Smart Litter System must only use our designated specialized washable cat litter. Use of non-designated litter (such as bentonite, tofu litter, etc.) may lead to system malfunction, filter clogging, accelerated wear, and subsequently void your product warranty.
• Installation Environment Responsibility: The user is responsible for ensuring the installation environment (such as plumbing and power supply) meets Petalas installation requirements.
• Exclusive Detergent Requirement: You must exclusively use the Petalas brand specialized detergent. Other brand detergents may lead to:
  1. Incomplete cleaning and sterilization (residual soil encouraging bacterial growth).
  2. Interference with the water level sensor sensitivity (risk of overflow, short circuits, and severe device malfunction).

2.2 Return Policy for Sanitary Goods

Due to the nature of the Petalas Smart Litter System as a sanitary and hygiene product, we implement a strict non-return policy once the product has been used. Returns or exchanges are only accepted for non-quality related issues if the product remains unused and in its original, sealed packaging. This policy is enforced to prevent the risk of cross-contamination among cats.

2.3 Assumption of Risk

You understand and agree that your use of the Petalas Product, application, and all related information is at your sole risk. To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, punitive, or consequential damages (including but not limited to damages to pet health, household plumbing, devices, or any other personal property) arising out of or in connection with the use or inability to use the Product.

3. Application and Software License

3.1 License Grant and Restrictions

The Company grants you a limited, non-exclusive, non-transferable license to install and use the Petalas application and the embedded firmware of the product ("Software"). You agree not to:

• License, sell, rent, transfer, distribute, or otherwise commercially exploit the Software.
• Modify, create derivative works, decompile, or attempt to extract the source code from the Software.
• Use the Software for any illegal or unauthorized purpose.

3.2 Software Updates and Service Interruption

You agree that the Company reserves the right to automatically update or modify the Product firmware and application at any time without prior notice. If you do not accept automatic updates, your sole remedy is to discontinue use of the Product and associated Software. We reserve the right to modify or terminate part or all of the Services at any time, and we will attempt to provide advance notice when possible.

4. Intellectual Property

The Petalas Product, Software, design, brand names, website content, and all associated patents, trademarks, copyrights, and trade secrets are the property of Petalas and are protected by intellectual property laws. The license granted to you under these Terms is for the use of the Software only and does not constitute a transfer of any intellectual property rights.

5. User Conduct and Content

5.1 Account Security

You are responsible for maintaining the confidentiality of your Petalas account and password and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account.

5.2 Submitted Content

If you provide us with any feedback, suggestions, or ideas ("Submissions"), you hereby irrevocably grant us the right to use these Submissions to improve our products or for marketing purposes without any compensation to you.

6. Privacy Policy

Our use of your personal data and your cat's health data is governed by our Privacy Policy, which is incorporated by reference into these Terms. Your use of the Product signifies your agreement to our data processing practices.

7. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People's Republic of China. For any dispute arising out of or related to these Terms, both parties shall first attempt to resolve it through good-faith negotiation. If a resolution cannot be reached, the dispute shall be submitted to the courts of Hong Kong for resolution.

8. Termination

We reserve the right to terminate your access to the Product or Services without prior notice if we believe you have violated any provision of these Terms. All provisions regarding limitation of liability, indemnification, intellectual property, and dispute resolution shall survive the termination of this Agreement.
